description: | The research project sets objective to analyze comprehensively Estonian legal space, taking as a basis Estonian national legal order and its development, but considering its interconnection with global legal order through all branches of law, for the first time in the Estonian legal research. The research is analyzing all instruments of global legal integration: 1) unilateral integration – this aspect requires analysis of realities and development of national legal order; 2) multilateral treaties – as there are no legislators above states this aspect calls for analysis of instruments employed to produce legal norms that would allow co-operation of national legal orders; 3) voluntary unilateral parallel legislation – the analysis will entail capabilities of different sources of law, e.g., co-operation in Scandinavian legal space, experience of UNCITRAL, etc.; 4) uniform set of legal norms based on selfregulation of transnational economy and objective law (lex mercatoria); 5) international model laws, e.g., The Princiles of European Contract Law (PECL) and UNIDROIT Principles of Commercial Contracts (UPICC); 6) judge-made law – these issues need analysis primarily because Continental-European legal culture did not recognize for long time judge-mad law as a source of law; 7) jurisprudence as comparatively independent potential developing Estonian legal space. |
